Do domestic workers get paid for a no show because of disastrous weather?

General Rule: No Work, No Pay

If a domestic worker is unable to come to work due to floods, severe storms, or transport issues caused by weather, and they do not have available paid leave, the principle of "no work, no pay" generally applies. The employer is not obligated to pay for a day not worked.

Alternative Options for Employers

To avoid a deduction in pay, employers and domestic workers can consider the following, often handled by mutual agreement:

Annual Leave:
The day can be deducted from the worker's paid annual leave entitlement.

Paid Time Off/Advanced Leave:
The worker can take paid time off with the understanding that they will make up the hours at a later date, or receive a "loan" of paid days.

Family Responsibility Leave:
If the weather has caused an immediate emergency situation at the worker’s home, they may be eligible to use part of their annual 5-day paid family responsibility leave.

Key Reminders

Minimum Wage:
As of March 1, 2024, the minimum wage for domestic workers is R27.58 per hour.

Documentation:
It is recommended to have a written employment contract that outlines how bad weather days are handled.
