🚨 THE SICK NOTE IS VALID… BUT THE ABSENTEEISM PROBLEM ISN'T GOING AWAY!

Sound familiar?

An employee is regularly absent. Medical certificates are submitted. The business continues paying the price through disrupted operations, overtime and increased pressure on colleagues.

So, what can an employer actually do?

Here's what many businesses get wrong:

❌ Assuming a medical certificate means nothing can be done.
❌ Treating every absence as misconduct.
❌ Failing to identify recurring absence patterns.
❌ Waiting until the situation becomes unbearable before acting.

βœ… The answer is proactive absenteeism management.

Employers have the right to manage attendance, but must distinguish between genuine medical incapacity and misconduct, and follow the appropriate process.

At AXIOM Labour & Workplace Advisory, we help employers:

βœ”οΈ Analyse absenteeism trends
βœ”οΈ Develop practical attendance management strategies
βœ”οΈ Manage incapacity and disciplinary processes
βœ”οΈ Strengthen workplace policies
βœ”οΈ Implement fair and legally defensible HR solutions

πŸ’‘ **The question isn't only why an employee is absent. It's whether you're managing the situation effectively.**

🚨 **β€œI REFUSE TO SIGN THAT WARNING!”**

βš–οΈ **EMPLOYERS, NOW WHAT?**

You've followed a disciplinary process, decided that a written warning is appropriate and called the employee in to issue it.

The employee reads the warning, pushes it back across the table and says:

πŸ—£οΈ **β€œI'm not signing anything!”**

Does that mean the warning is invalid?

**ABSOLUTELY NOT!**

Here's what every employer should know. πŸ‘‡

βœ… An employee's signature generally acknowledges receipt, not necessarily agreement with the warning.

βœ… Refusing to sign does not automatically invalidate an otherwise fair warning.

βœ… Record the refusal and have a witness confirm that the warning was communicated.

βœ… Provide the employee with a copy and retain proper records.

⚠️ **BUT HERE'S WHERE EMPLOYERS GET IT WRONG!**

A witness's signature does not fix an unfair disciplinary process.

You must still be able to demonstrate that:

βœ”οΈ There was a legitimate reason for the warning.

βœ”οΈ The employee had an appropriate opportunity to respond.

βœ”οΈ Discipline was applied fairly and consistently.

βœ”οΈ The sanction was appropriate to the misconduct.

πŸ’‘ **THE AXIOM PERSPECTIVE**

**Good discipline isn't about getting an employee to sign a document. It's about being able to defend the process behind it.**

At AXIOM Labour & Workplace Advisory, we assist employers with disciplinary processes, investigations, workplace policies and practical labour relations advice.

🚨 **EMPLOYERS: ONE HR MISTAKE COULD COST YOUR BUSINESS THOUSANDS!**

You can have a valid reason to discipline or dismiss an employee and still end up losing your case at the CCMA.

**Why?** Because having a case and managing it correctly are two very different things.

❌ Poorly drafted disciplinary charges
❌ Inadequate investigations
❌ Procedural mistakes
❌ Weak evidence preparation
❌ Chairpersons whose independence is compromised

At AXIOM Labour & Workplace Advisory, we help employers get it right BEFORE things go wrong.

βœ… Workplace investigations
βœ… Disciplinary charge sheet drafting
βœ… Independent disciplinary chairing
βœ… Employer representation and case preparation
βœ… Employment contracts and HR policies
βœ… Labour relations advice and workplace compliance

Whether you employ 5 people or 500, you deserve access to professional, practical and affordable HR support.

🚨 **β€œI HAVE DEPRESSION. YOU CAN'T DISCIPLINE ME!”**

βš–οΈ **NOT SO FAST, SAYS THE LABOUR APPEAL COURT.**

An employee was absent from work for 17 days, failed to follow absence-reporting procedures, was insolent towards a superior and refused a lawful instruction.

**He was dismissed.**

But there was a complication.

The employee suffered from depression, and his employer knew about it.

The Labour Court found his dismissal automatically unfair and ordered his reinstatement.

**Then the Labour Appeal Court overturned that ruling!**

πŸ“š **THE CASE:**
*Legal Aid South Africa v Jansen* [2020] ZALAC 37

So, what did the Court actually say?

βš–οΈ **THE IMPORTANT DISTINCTION**

Having a mental health condition does NOT automatically protect an employee from disciplinary action.

However, the employer must distinguish between:

❌ **MISCONDUCT:** An employee who is capable of complying with workplace rules but fails to do so.

⚠️ **INCAPACITY:** An employee whose medical condition genuinely prevents them from appreciating or controlling their conduct.

And here's where things get particularly interesting...

**Even when misconduct is proven, a medical condition may reduce the employee's blameworthiness and influence whether dismissal is appropriate.**

In Jansen's case, the LAC found insufficient evidence that his depression prevented him from appreciating the wrongfulness of his conduct or acting accordingly.

The Court accepted that disciplinary action was justified. Importantly, it did not make a final determination on the overall fairness of the dismissal.

πŸ’‘ **THE LESSON FOR EMPLOYERS**

Before you issue that charge sheet, ask yourself:

πŸ‘‰ Is this employee **unwilling** to comply, or genuinely **unable** to comply?

πŸ‘‰ Do we have evidence connecting the medical condition to the alleged misconduct?

πŸ‘‰ Have we considered reasonable accommodation and whether an incapacity investigation is appropriate?

πŸ‘‰ If misconduct is proven, have we properly considered mitigation before deciding on dismissal?

**Getting the distinction wrong can turn a seemingly straightforward disciplinary matter into an expensive labour dispute.**

At AXIOM Labour & Workplace Advisory, we help employers make defensible decisions through sound investigations, disciplinary processes, incapacity guidance and independent chairing.

🚨 **YOUR EMPLOYEE MAY BE GUILTY. YOUR DISMISSAL MAY STILL BE UNFAIR.**

Read that again.

One of the biggest mistakes employers make is believing that proving misconduct automatically justifies dismissal.

It doesn't.

At the CCMA, employers must be able to demonstrate that the dismissal was both substantively and procedurally fair.

βš–οΈ Consider these common mistakes:

❌ Poorly drafted or unclear disciplinary charges.

❌ Insufficient evidence to support the allegations.

❌ Inconsistent application of discipline.

❌ Failing to give the employee a fair opportunity to respond.

❌ Imposing dismissal without properly considering mitigating circumstances and whether dismissal is appropriate.

The problem isn't always what the employee did. Sometimes it's how the employer handled it.

At AXIOM Labour & Workplace Advisory, we help employers get disciplinary processes right through professional investigations, disciplinary preparation, independent chairing and practical labour relations advice.

πŸ’‘ Good evidence deserves a fair process. Don't let poor preparation undermine your case.

βš–οΈ **FRIDAY CASE LAW | EMPLOYER ORDERS EMPLOYEE BACK TO OFFICE β€” ENDS UP PAYING 8 MONTHS' SALARY!**

Imagine dismissing an employee for refusing to follow an instruction, only to discover that the instruction itself was unreasonable!

πŸ“š **CASE: Medici Energy (Pty) Ltd v Bennet NO and Others [2025] ZALCCT 34**

An employee had worked from home for more than two years under an agreed arrangement.

On a Friday, her employer instructed her to return to the office the following Monday.

When she failed to comply, she was charged with gross insubordination and dismissed.

🚨 **THE PROBLEM?**

The instruction was issued shortly after the employee indicated that she intended to lodge a workplace grievance.

The Labour Court found no basis to interfere with the CCMA's conclusion that the instruction was unreasonable and retaliatory.

The disciplinary process was also unfair.

πŸ’° **THE OUTCOME?**

The employee was awarded compensation equivalent to **8 MONTHS' SALARY**, and the employer's attempt to overturn the award failed.

πŸ’‘ **THE LESSON FOR EMPLOYERS:**

βœ… An instruction must be lawful AND reasonable.

βœ… Disciplinary action must never be used as retaliation.

βœ… Employees must receive a fair opportunity to defend themselves.

βœ… Even where misconduct is alleged, the employer must be able to justify its actions.

**An employer's authority to give instructions does not make every instruction reasonable.**

At AXIOM Labour & Workplace Advisory, we help employers manage disciplinary matters fairly, professionally and defensibly.

⚠️ β€œBut we’ve always done it this way” is not an HR policy.

Many workplace problems don’t start with a difficult employee.

They start with unclear rules, inconsistent management and poor documentation.

Then, when something goes wrong, the employer suddenly needs to prove:

βœ”οΈ What was the rule?
βœ”οΈ Was the employee aware of it?
βœ”οΈ Was it applied consistently?
βœ”οΈ Was the employee given a fair opportunity to respond?
βœ”οΈ Can we actually prove what happened?

Good HR is not about creating paperwork for the sake of paperwork.

It’s about putting the right processes in place before you need to defend a decision.

At AXIOM Labour & Workplace Advisory, we help employers strengthen their HR practices, policies and disciplinary processes β€” practically and professionally.
