PSCBC Bargaining Council The PSCBC is an independent organisation established in terms of Section 35 of the Labour Relations Act 66 of 1995 (LRA), read with Sections 36 and 37.

The main objective of the organisation is to maintain good labour relations in the Public Service.

The PSCBC is meeting with the GEMS Board of Trustees at the Council offices as part of its ongoing engagement and relationship management strategy. On the agenda is the implementation of the revised GEMS medical aid contributions, which are expected to commence on 1 July 2026, as well as a discussion on the progress of product development consultations.

These engagements provide an important platform for consultation and collaboration on matters affecting GEMS members.

The Labour Court in Nxele versus Department of Correctional Services clarified the interpretation of the 60-day precautionary suspension period within the public service. The Court held that the period must be calculated based on working days, thereby excluding weekends and public holidays unless the employee is contractually required to work on such days.

Accordingly, the suspension in question had not lapsed, and the employee was not entitled to return to work. This judgment reinforces the importance of accurate time calculation and procedural fairness in disciplinary processes.
