Being called an “independent contractor” doesn’t automatically make you one.
In New Jersey, worker classification depends on the actual working relationship, not simply your job title, contract, or whether you receive a 1099.
Why does that matter? Because employees may be entitled to important workplace protections, including minimum wage, overtime, unemployment benefits, workers’ compensation, and other employment protections.
If you’re unsure how your work should be classified, it’s worth looking beyond the label and considering the facts of your working relationship.
Your job title doesn’t tell the whole story.
