Many of the people who consult us come with the same concern: they work more than 40 hours a week, but after watching our videos, they realized they aren’t being paid correctly for their overtime.

👉 In this carousel, we present three common situations that clients bring to us, and these are usually cases we end up taking on.

People often assume that the boss is always right or that, because they agreed to a verbal arrangement, there’s nothing they can do about it. However, for the vast majority of employees in operational and manual labor roles (construction, food service, warehouses, cleaning, transportation, and repair shops), the law protects their right to receive time and a half for every hour worked beyond 40 hours per week. And this applies REGARDLESS of your immigration status.

Short answer: in most cases, yes. 😬

If you’re in a state where employment is “at-will”, which is most of the United States. That means an employer can generally end your job at any time, with or without notice, and without giving a reason.

But “no reason” is not the same as “an illegal reason.”

Even in an at-will state, your employer can’t fire you because of:

❌ Discrimination (race, s*x, age, disability, religion, pregnancy, and other protected traits)
❌ Retaliation (complaining about harassment, discrimination, or unpaid wages)
❌ Taking legally protected leave
❌ Reporting illegal activity (whistleblowing)
❌ Violating a written or implied employment contract
❌ Exercising a legal right, like filing a workers’ comp claim or serving on a jury

If you think the real reason you were let go was one of these, the timing, the paper trail, and what was said to you can all matter.

⚖️ Settlement Secured ⚖️

Suffering a work-related injury and requesting reasonable accommodations is NOT a wrongdoing: it is a right protected by law.

Unfortunately, as happened with our client, many companies respond with hostility when an employee is injured: performance warnings that didn’t exist before the accident, drastic cuts in hours, and fabricated excuses to justify an illegal termination.

No company can punish, reduce the pay of, or fire a worker for reporting a workplace accident. Holding companies fully accountable and fighting for the fair compensation every worker deserves is essential.

If you’ve gone through something similar or faced retaliation after being injured, know your rights. 💼🏛️✨

If your hours were cut after reporting an injury or you were fired for requesting reasonable accommodations, you’re not alone. Let’s talk about your rights. 📲 1-833-522-6274

🔥$40,000🔥
Our client, a restaurant worker, came to us after being unlawfully terminated. While speaking with her, we discovered she had been working over 40 hours a week as both a cook and server, without receiving proper overtime pay.

To hide the overtime, her employer put her waitress hours on official payroll with paystubs, but paid her cooking hours off-the-books via Zelle. On top of that, they deducted pay for breaks she never took.

When she developed a health condition, management ignored her requests for sick leave and disability assistance, then unfairly terminated her.

We stepped in and recovered $40,000 for unpaid wages and illegal retaliation.

Is your employer doing any of the following?
-Deducting break time you never got to take.
-Paying cash/Zelle under the table to avoid overtime.
-Firing you after you request sick leave or medical accommodation.

You have rights, and we can help.

Can you be prohibited from discussing your salary in Pennsylvania? 💰

Federal law is the main factor here.
The National Labor Relations Act (NLRA) generally protects private-sector employees who discuss their wages and working conditions with their coworkers.

Therefore, for many workers, a rule that states:
“You are prohibited from discussing your salary with other employees.”
may be illegal.

And an employer can get into trouble if they discipline or retaliate against a worker for engaging in protected activities related to their wages and working conditions.

⚠️ The NLRA does not cover all workers, so it’s important to determine whether you fall into a protected category.

How many hours can an employee legally work in Pennsylvania? 👀

For an adult worker, there is no general maximum number of weekly hours set by state law.

That means 40 hours is NOT a limit on how much you can work.

The law sets overtime rules for hours worked beyond 40 in a week, but it does not prohibit an adult worker from continuing to work beyond that point.

⚠️ There are special rules and exceptions for certain workers, industries, and situations.

Therefore, if your employer is making you work extremely long shifts or weeks, it’s important to check which laws apply to your specific job.
