There's a payroll reporting change in effect for 2026 that impacts you.

The One Big Beautiful Bill Act introduced new tax deductions for qualified tips and overtime.

Here's what you need to do now:

๐Ÿ“ž Talk to your payroll provider

Confirm your system can separately track and report FLSA-required overtime and cash tips in the updated W-2 format.

๐Ÿ‘ฅ Know which employees generate qualifying overtime

Only FLSA-required overtime qualifies. If you've been treating all overtime as a single line item, that needs to change now.

๐Ÿ’ฐ Check your tipped roles

Confirm which occupations are covered under the IRS list of occupations that customarily and regularly receive tips.

๐Ÿ’ฌ Tell your employees the deduction exists

One toxic employee can wreck a team that took you years to build.

It rarely starts as something obvious.

It begins with small things.

A comment here. A bit of negativity there. Someone quietly pushing boundaries.

Over time, negativity spreads.

Bad behavior becomes normal.

Good people disengage or quit.

Team performance breaks down.

And then your time gets consumed managing the fallout instead of running your business.

Early intervention is the only thing that stops it from getting there. Here's how to handle it.

1. Name the behavior, not the person

Be specific about what's happening rather than reaching for labels like "difficult" or "toxic." Vague labels won't hold up if the situation escalates.

2. Document everything

Write down specific examples and the impact they're having on the team or the business.

If this ever leads to termination, your documentation is what protects you from a wrongful termination claim.

3. Have the conversation early

The longer you wait, the harder it gets. The earlier you address it, the more likely it is to change.

4. Set clear expectations

Be explicit about what needs to improve, by when and what will happen if it doesn't. Put it in writing.

5. Follow through

If nothing changes, you need to act. Resetting the situation without consequences tells everyone on your team that the behavior is acceptable.

But, actually, under U.S. federal law, probationary periods have no special legal status.

They don't give you protection you don't already have and, handled the wrong way, they can actually create exposure you didn't intend.

A few things worth knowing before your next hire starts:

A good time to review what's happening inside your own workplace.

Here's where to start:

1. Make sure that your EAP is genuinely visible. ๐Ÿ“‹

Having it listed in the employee handbook isn't enough if nobody knows how to use it.

Only 53% of employees know how to access mental health care through their employer, so promote it regularly and make it easy to find.

2. Train your managers. ๐Ÿ—ฃ๏ธ

They need to know how to recognize early signs of struggle and have supportive conversations.

Just over 20% of workers receive any training about mental health conditions or symptoms, which means that most managers are left to figure it out on their own.

3. Know the difference between a performance issue and a health issue. โš ๏ธ

If someone's output has dropped, it's worth asking what's going on before jumping straight to a performance conversation.

4. Understand your obligations. โš–๏ธ

Under the ADA around reasonable accommodations for employees dealing with mental health conditions.
