Fourteen years ago, my office filed a class action lawsuit against Polo Ralph Lauren over its practice of conducting "bag checks" or loss prevention inspections of employees after they had clocked out and were no longer being paid for their time. At issue in the case was whether the time our 6,700 clients spent waiting for and undergoing bag checks for stolen merchandise was compensable. The case settled in 2010 for $4 million during trial, after we had presented our evidence.
Just this past Thursday, February 13, 2020, the California Supreme Court ruled that time is indeed compensable under California law. The law was unsettled on this issue in 2006 when we filed the Polo class action. The law is now settled!
