Sarah Prescott of Salvatore Prescott Porter & Porter, acting as counsel for amicus curaie Michigan Association for Justice, filed a brief in this week's blockbuster Civil Rights matter, Hudson v. MDOC, arguing that a change in practical enforcement of filing deadlines should not be retroactively enforced to negate the rights of the many civil rights matters in process when the ruling of Christie v. Wayne State was handed down in 2023.

SPPP said goodbye last week to two fantastic University of Michigan students who worked with us this summer. Julia Robinson, a graduate of Miami University, is returning to the University of Michigan Law School to begin her second year and Lucia Farah is returning to begin her junior year at Michigan. We were so lucky to have Julia and Lucia as integral members of our SPPP team this summer and wish them the best in their upcoming academic year!

This week, Salvatore Prescott Porter & Porter successfully defended University of Michigan Law Professor Rachel Rothschild against an effort to convert her private correspondence into public property. This work was joint with the University of Michigan and the inimitable team at the Climate Science Defense Fund.

Professor Rothschild is a scholar of environmental law and legal history whose research on state climate superfund statutes has informed legislation in several states. That is why she has been targeted. The requester was Government Accountability & Oversight, a nonprofit that received $300,000 from Murray Energy — disclosed in the coal company's 2019 bankruptcy filings — and whose board includes Christopher Horner, who has publicly asserted that global temperatures were not rising. GAO has ceaselessly hounded climate and energy researchers, state officials, and public university faculty, trying to access their personal projects.

We are not neutral about their tool, Michigan's Freedom of Information Act. Our firm uses it constantly, against state agencies and public institutions, on behalf of vulnerable clients, in support of voting rights and more. It is one of the most important tools an individual has against an institution.
..Which is exactly why it matters what it covers. FOIA reaches the work of public bodies. It is not a subpoena power handed to whoever dislikes a professor's conclusions or a scientist's findings. The Court's ruling drew that line where the statute draws it: between records created in the performance of an official function and correspondence that was never the public body's business at all.

That distinction protects every researcher at every public institution in Michigan — including, and this is the point, the ones whose conclusions we would disagree with.

A conservative group is suing for emails of a law professor who helped create legislation to force oil, gas and coal companies to pay for climate damage.

SPPP proudly announces another win in this pivotal case on voter privacy.

The case asks whether the Justice Department can force the state to turn over sensitive voter-roll information on millions of registered voters.

With the incredible team at the Democracy Docket, SPPP intervened in this case for two Michiganders seeking to protect the rights of all. Michigan had already turned over the public statewide voter list but refused to provide its confidential data, saying the federal government had no legal authority to demand our addresses, dates of birth, driver’s license or state ID numbers, jurisdictional information, voting history and digital signatures.

Sarah Prescott's State Bar of Michigan article, "Defeating Motions for Summary Judgment in Employment Matters: Starting with the End in Mind" is out. The article offers practical tips and recent cases to defeat dispositive motions.

Defeating a motion for summary judgment is ideally not a single moment in employment litigation. This article is a field guide of practical strategies, favorite citations, and framing techniques to defeat these motions from a case’s inception.
