Partner Pawel P. Wierzbicki, along with Associate Kristian Krober, secured a $1,150,000 settlement for a union plumber injured on a Manhattan construction site.

While removing a cast iron pipe from a building’s mechanical room, the unsecured pipe suddenly pulled our client’s arm downward with significant force, causing a serious bicep tear that required surgery.

Our attorneys argued that the Defendants violated New York Labor Law §240(1) by failing to properly secure the pipe before removal. Although the defense filed a motion for summary judgment seeking dismissal of the case, the matter was resolved before the Court rendered its decision.

We hope this settlement helps ease our client’s burden and supports him moving forward.

He sustained serious fractures to his left forearm, which required surgery to repair, as well as shoulder and foot injuries. Partners Daniel P. O’Toole, Frederick C. Aranki, and Pawel P. Wierzbicki obtained a $5,250,000 recovery for a union sandhog who was injured after falling approximately three feet while descending a makeshift ladder at work.

Our client had a documented preexisting lumbar spine condition which he received treatment for prior to the accident. Nevertheless, our attorneys successfully established that the workplace accident significantly exacerbated his condition and caused additional injuries. Following the accident, our client ultimately required a hemilaminectomy and knee arthroscopy.

The $5.25 million result demonstrates that a relatively short fall and a history of prior treatment does not necessarily mean a minor case. What matters is proving how the accident changed the client’s condition and impacted his life.

Associate Aaron R. Fishkin and Partners Stephen J. Murphy and David L. Scher obtained a $1,700,000 settlement for a 57-year-old maintenance worker who was injured while riding an elevator that abruptly dropped and stopped, ultimately requiring him to undergo a neck procedure.

The case was extensively investigated and litigated. The firm retained an elevator expert who found that the defendant elevator company violated applicable elevator safety code requirements and failed to properly diagnose and repair repeated issues with the elevator before the incident. During depositions, our attorneys also established that the elevator had a history of problems and had been serviced just 13 days before the incident.

The defense contested liability and causation, arguing that the plaintiff’s neck injury was degenerative and denying that the elevator dropped in a manner capable of causing his injuries. Despite those defenses, the case settled prior to jury selection.
