Partners Frederick C. Aranki, and Pawel P. Wierzbicki obtained a $1,500,000 settlement for a Polish bricklayer injured on a construction site when a large piece of stone struck him in the chin.

The stone, weighing approximately 180–200 pounds, had been improperly secured to a machine before being hoisted. It came loose during the lift and struck our client, causing serious cervical spine injuries that ultimately required surgery.

Our attorneys pursued claims for past and future medical treatment, as well as past and future pain and suffering. Notably, no claim for lost wages was made in this case.

After the Court denied Defendants’ motion for summary judgment, the matter proceeded to mediation, where our attorneys secured a $1,500,000 settlement to help support our client moving forward.

Partner Pawel P. Wierzbicki, along with Associate Kristian Krober, secured a $1,150,000 settlement for a union plumber injured on a Manhattan construction site.

While removing a cast iron pipe from a building’s mechanical room, the unsecured pipe suddenly pulled our client’s arm downward with significant force, causing a serious bicep tear that required surgery.

Our attorneys argued that the Defendants violated New York Labor Law §240(1) by failing to properly secure the pipe before removal. Although the defense filed a motion for summary judgment seeking dismissal of the case, the matter was resolved before the Court rendered its decision.

We hope this settlement helps ease our client’s burden and supports him moving forward.

Partners Daniel P. O'Toole, Frederick C. Aranki, and Pawel P. Wierzbicki secured a $5,000,000 settlement for a union carpenter who was struck by a large piece of falling duct while working at his Manhattan job site. The forceful impact caused serious head and neck injuries, leaving our client completely unable to work in his field.

Our attorneys filed a motion for summary judgment under Labor Law 240(1) and 241(6), which the court granted. The case was then scheduled for a damages-only trial, to be handled by Partner Scott Occhiogrosso, Mr. Aranki, and Associate Gabriela Pulla. However, just prior to the start of jury selection, the defense agreed to settle the case for $5,000,000. We hope the settlement will bring our client some measure of relief in his recovery journey.

Associate Aaron R. Fishkin, along with Partners Stephen J. Murphy and David L. Scher, recovered a $2,775,000 settlement on behalf of a 28-year-old construction worker who fell from an extension ladder while performing external facade work. While our client was working on the ladder, it slipped, causing our client to fall 7–8 feet and suffer a right ankle fracture. The plaintiff underwent multiple procedures, including external fixator placement, open reduction and internal fixation (ORIF), and pin removal.
The defendants contended that the plaintiff was the sole proximate cause of the accident. Defendants also noted that the plaintiff made a strong enough recovery that he returned to his construction work post-accident. However, our attorneys successfully established the defendants' liability for failing to provide adequate fall protection and secured full compensation for their client's injuries.
