Eliminating a Letter of Intent (LOI) can be seen as both good and bad depending on the context, as it can potentially increase flexibility in negotiations but also create uncertainty and potential for misunderstandings, especially in complex transactions where clear initial parameters are important; in the case of college athletics, recent NCAA changes eliminating the National Letter of Intent are seen as a way to adapt to the evolving landscape of player recruitment and compensation. 

POTENTIAL BENEFITS OF ELIMINATING AN LOI:

GREATER FLEXIBILITY:
Without a formal LOI, parties can continue negotiating key terms without feeling bound to a preliminary agreement, potentially leading to more creative solutions.

REDUCED PRESSURE:
Eliminating the LOI can alleviate pressure on parties to quickly finalize a deal, allowing for more thoughtful consideration.

LESS POTENTIAL FOR DISPUTES:
If parties clearly understand that an LOI is non-binding, it can minimize legal issues arising from interpretations of its terms.

POTENTIAL DRAWBACKS OF ELIMINATING AN LOI:

UNCERTAINTY AND CONFUSION:

Coaches will have to wait even longer before seeing recruits in action.
This afternoon, the NCAA’s Division I Council announced it would be extending the current recruiting dead period in all sports through Aug. 31.
Now, no in-person recruiting will be allowed to take place, limiting coaches to phone calls and video conferences..

The Council also increased the roster limit in baseball for student-athletes impacted by the COVID-19 pandemic, the only spring sport with such a limit.
