On Friday, August 28th, Partner Jacqueline Berger delivered her annual presentation at Flushing Hospital Medical Center’s Department of OB/GYN.

Ms. Berger’s presentation covered the topic: Mitigating Legal Exposure in OB/GYN Cases. Ms. Berger’s presentation to attending and resident physicians focused on specific issues faced by OB/GYN physicians in medical malpractice cases. The presentation also concentrated on how to use communication and documentation to build a defense and to mitigate these high exposure cases.

Senior Trial Partner Jacqueline Berger and Senior Associate Daniel Borbet successfully obtained Summary Judgment in Queens County Supreme Court on behalf of MCB’s nursing home client in a case involving allegations of negligence in the prevention and treatment of pressure ulcers, resulting in sepsis and death.

The Court found that plaintiffs’ experts failed to raise a triable issue of fact and that their opinions were speculative and conclusory. The Court granted Summary Judgment, dismissing the case against MCB’s client in its entirety.

Senior Trial Partner Laurie Ann Annunziato and Associate McKenzie Nelson successfully obtained Summary Judgment in Queens County Supreme Court in a medical malpractice matter involving complications arising from a laparoscopic procedure, converted to an open procedure, to repair a large paraesophageal hernia.

MCB established that the splenic artery injury was a known and accepted risk of the procedure that could occur in the absence of negligence. The Court found that the defense established its prima facie entitlement to Summary Judgment and that Plaintiff failed to rebut the defense’s arguments.
