Hurt on the job and told to come back on "light duty"? Here is what that actually means for you.

Light duty is a modified work assignment based on the restrictions your treating physician sets, not your employer. It could mean shorter shifts, no heavy lifting, or a temporary move away from your regular duties.

Your doctor decides what you can and cannot do. If your employer asks you to do tasks outside those restrictions, you have the right to decline and to notify your attorney.

If you are considering resolving your Florida workers' compensation claim, it helps to understand your options first. Some claims settle through a lump sum payment, while others continue with ongoing benefits over time. Each approach affects your future medical care and income differently, and a settlement is generally final once approved. Before agreeing to any settlement, it is worth having your full case reviewed so you understand exactly what you may be giving up. Call De Cardenas Freixas Stein & Zachary, P.A. at 305-377-1505 before you sign anything. 📄

Not every workplace injury happens in a single moment. Repetitive stress injuries, like carpal tunnel syndrome, and occupational diseases that develop from long-term exposure to hazardous conditions are also covered under Florida workers' compensation law. These claims can be harder to prove than a single accident because there is no one specific incident to point to. That does not mean your injury is any less real or any less compensable. If your condition developed gradually because of your job, call De Cardenas Freixas Stein & Zachary, P.A. at 305-377-1505 to talk through your case. 🪛

Workers' compensation is not always the only path to recovery after a workplace injury. If a third party, such as a subcontractor, equipment manufacturer, or property owner, contributed to your accident, you may be able to pursue a separate personal injury claim in addition to your workers' compensation benefits. These cases can allow for types of damages that workers' compensation does not cover. Identifying whether a third party was involved takes careful review of the facts. If you are unsure whether more than one claim applies to your situation, call De Cardenas Freixas Stein & Zachary, P.A. at 305-377-1505. ⚙️

South Florida's summer heat is more than uncomfortable, it can be dangerous for workers who spend long hours outdoors or in non-air-conditioned spaces. Heat exhaustion and heat stroke are recognized workplace injuries under Florida workers' compensation law, and employers are expected to provide reasonable safety measures. If you were hurt due to heat exposure on the job, from construction sites to warehouses to landscaping crews, you may be entitled to medical care and lost wage benefits. Do not dismiss heat illness as something you should simply push through. Call De Cardenas Freixas Stein & Zachary, P.A. at 305-377-1505. ☀️

Florida law requires most employers to carry workers' compensation insurance, but not every employer complies. If you are injured on the job and discover your employer is uninsured, you still have legal options. In some cases, you may be able to pursue a claim through the state's Uninsured Employers Fund, or file a civil lawsuit against your employer directly. Do not assume a lack of insurance means a lack of recourse. If you were hurt on the job and your employer says they have no coverage, call De Cardenas Freixas Stein & Zachary, P.A. at 305-377-1505 today. 🏗️

Not every workplace injury ends a career, but some require a new path forward. Florida workers' compensation law provides for vocational rehabilitation benefits in certain cases, helping injured workers retrain or transition into work they are still able to perform. These benefits are not automatic, and navigating eligibility can be confusing while you are also focused on recovery. If your injury has changed what kind of work you can do, you may have options you do not know about yet. Call De Cardenas Freixas Stein & Zachary, P.A. at 305-377-1505 to find out what benefits may apply to you. 🔧
