USCIS has issued a policy memo emphasizing that adjustment of status in the United States is an exercise of discretion — what the agency describes as an “administrative grace,” not an automatic right.
This policy memo is concerning for many immigrants and families, as discretionary review creates real uncertainty and anxiety. And so, many of our clients (including nurses) have reached out with understandable concern about how this may affect their Green Card cases after years of sacrifice, licensing, waiting, and caring for patients in our healthcare system.
The memo signals that officers may place greater emphasis on an applicant’s overall immigration history moving forward. At the same time, discretionary review is not arbitrary. Strong equities still matter — maintaining lawful status, stable employment, professional service, credibility, family and community ties, and honest disclosure of prior issues.
My advice remains the same: be proactive, be transparent, and document carefully. Many issues can still be addressed through careful legal strategy, strong documentation, and thoughtful advocacy.
