Many people assume a will and a trust accomplish the same thing. They don’t.

A will outlines what happens to your assets after you pass away, but it often still requires probate, a public, court-supervised process that can take time and create additional stress for loved ones.

4 actions to take before December 31st.

✅ ACTION 1 — REVIEW AND UPDATE BENEFICIARY DESIGNATIONS
Did you get married, divorced, have a child, or lose a beneficiary this year? Life insurance, retirement accounts, and payable-on-death accounts all pass outside your will, and outdated designations can send assets to the wrong person. Review every designation annually.

✅ ACTION 2 — USE YOUR ANNUAL GIFT TAX EXCLUSION
The annual gift tax exclusion is $18,000 per recipient (2024). It does not carry over to the next year; unused exclusion is lost. If you want to reduce your taxable estate through strategic gifting, December 31 is the deadline.

✅ ACTION 3 — ASSESS THE IMPACT OF ASSET OR LIFE CHANGES
Did you buy or sell real property this year? Start or sell a business? Inherit assets? Retire? Each of these events may require updates to your trust, will, or power of attorney. A significant change without a plan update creates gaps.

✅ ACTION 4 — EVALUATE HIGH-NET-WORTH TAX STRATEGIES BEFORE THE EXEMPTION SUNSET
The federal estate tax exemption is scheduled to drop significantly after this year. If your estate is approaching or exceeds $7–$14 million, the 2024–2025 window for transferring assets at the current higher exemption may be closing. Strategies like SLATs and GRATs must be implemented before the change takes effect.
