Earlier this year the DOL proposed new guidance on the Independent Contractor rule that would tighten how joint employer liability is analyzed under the FLSA, FMLA, and MSPA by focusing on the reality of the working relationship rather than just what the contract says. 📋

In practical terms, the proposal is aimed at situations where two entities both influence working conditions, supervise work, or share control over pay, scheduling, and employment decisions.

The goal is stated to be reducing the compliance burdens for employers and focuses primarily on two key frameworks: “vertical” and “horizontal” joint employment.

Healthcare wages are still rising in California. 📈
In San Diego, employers are competing in a market where pay has to reflect both local cost pressures and the scarcity of qualified talent, especially in health services roles. 🏥

Its scope extends into healthcare services, meaning many non-hospital employers that provide direct care or support care delivery may also need to track the wage schedule and compliance requirements closely.
