Practice Pointer:

New Adjustment of Status Policy Mandating a High Bar for a Positive Exercise of Discretion
AILA updated its practice pointer on USCIS policy memo PM-620-1099, which characterized adjustment of status as an act of extraordinary discretion. On Friday, May 29, press reported that DHS was apparently walking back the new policy, claiming there was no major change from the discretion immigration officers have long held. A USCIS spokesperson stated that the policy “will not prevent any alien from obtaining a green card who legitimately and properly qualify”; however, USCIS has not issued official guidance regarding any change in position. AILA is currently working with congressional offices and coalition partners to seek clarification. Please submit case examples to help us better understand how the policy is being implemented.
