In the EEOC, you don’t have formal discovery like you would in litigation after you file a lawsuit.

But that doesn’t mean you shouldn’t be thinking about discovery.

If the EEOC process fails, there’s a good chance you’re going to have to file a lawsuit.

So the conversations you had before could be discovered. And you have to hand them over to the company.

But if you talk to an attorney instead, you’ll be protected by attorney client privilege.

Even if HR is part of the problem, you should still report them.

If you don’t report something, you are not going to have anything that should have triggered a response.

File multiple reports so that you can show that HR did not do anything.

It may be a good idea to send something to the CEO or separate ethics line if that exists too.

Document so that you’re covered.

And then you can show how HR really acted.

Here’s a quick run down of where you need to file your claim depending on what happened to you:

1)EEOC

For discrimination, harassment, different treatment and wrongful termination. Must be based on protected class.

2)OSHA

For issues with health and safety.

3)DOL

For issues with unpaid wages and overtime.

4) NLRB

For issues with the union or collective bargaining agreement.

Each of those generally have retaliation related to your reports baked in too. So if something happens after your report, let them know!

While you’re still working with the company there’s about three different things you can do.

1) file complaint with HR

This must be in writing to protect yourself. That way, the company can’t say they never received it.

2) file a charge or claim with administrative agency.

Most likely you will need to file with the EEOC, the NLRB or OSHA. Where you file depends on the type of claim that you have.

3) SUE the company.

Sometimes you don’t have to go through the administrative process, and you can just file a lawsuit directly. You can do that whether you’re employed or not.

NEVER sign a severance agreement without taking to an attorney first.

If you sign without getting a review, you could be missing out on more money AND waiving your rights to any claims.

Everyone loves having a day off. Especially for a holiday!

But one thing people don’t realize is that days off for holidays are not guaranteed.

There are no federal laws that say that you have to be off for holidays, that company has to give you PTO for holidays, or that a company has to pay you more on days that you work for a holiday.

All of those things are voluntary benefits that companies offer to be competitive.

Just because there’s no federal law that doesn’t mean that there’s no state law. So check your state to see if you have any other protections!
