Over the last thirteen months, the rules, fees, and pathways around international hiring have changed again and again. One change gets resolved, and another one appears.

This isn’t about saying H-1B is gone. It’s about recognizing that you can’t build a reliable hiring plan around a system you can’t predict. For a growth stage company, that uncertainty lands directly on the roadmap.

That doesn’t mean abandoning the people already on your team. It means adding another hiring channel, like qualified engineers who work in your time zone and operate as part of your team. The goal isn’t to replace anyone. It’s to make sure one policy change doesn’t stop your roadmap.

DHS has proposed a $103,265 fee per cap subject H-1B petition, paid by the employer.

For a Series A company sponsoring three engineers, that’s more than $300,000 before any of them starts.

A separate proposal would add a $70,000 fee for each student’s first OPT, paid by the school, which can pass the cost on to students or employers.

Both are still proposals, so the final numbers aren’t set. Have you considered how that could affect your 2027 hiring plan, and how you can mitigate it?

June 2026: a federal court vacates it. August: DHS proposes a new $103,265 fee per cap subject petition.

September 2026: the proclamation is extended through September 2027, while collection stays blocked. Early October: a fee for each student’s first OPT is proposed.

October 8 2026: eight companies are suspended from green card sponsorship.

None of this is a ban, but rules that change every few weeks are hard to plan around. We feel for the people whose career plans are caught in it, and for the growth stage SaaS teams working through what it means for 2027.
