📌 **NOTARY AWARENESS: When Doing Everything Right Still Isn’t Enough**

A recent National Notary Association article shared a powerful cautionary story about a 94-year-old signer whose will ultimately became the subject of a lawsuit.

The Notary did what appeared to be everything correctly:

✔️ Verified the signer’s identity
✔️ Personally witnessed the signing
✔️ Observed that the signer was alert and engaged
✔️ Watched the signer read the documents and ask questions
✔️ Respected the signer’s initial decision not to sign
✔️ Returned later when the signer was ready

But after the signer passed away, a disinherited family member challenged the estate documents—and sued the Notary.

The family members who benefited from the will failed to defend themselves, leaving the Notary as the only remaining defendant and a potential source of financial recovery.

Even though the Notary’s insurer and attorney believed the Notary had a strong defense, the cost of continuing the lawsuit threatened to exhaust the Notary’s $100,000 E&O policy.

The case ultimately settled for **$72,000, plus legal expenses**, using nearly the entire policy.

# # # 📝 The BIG lesson for Notaries:

Sometimes the biggest risk isn't doing the notarization incorrectly.

It's what happens **afterward** when circumstances change, people are no longer available to testify, and your journal becomes one of the few records showing what actually happened.

For Notaries, this is a reminder to:

🔹 Document the signer’s willingness and apparent awareness.
🔹 Document refusals, hesitation, and return visits.
🔹 Keep thorough journal entries.
🔹 Consider independent witnesses when appropriate.
🔹 Review your E&O coverage to make sure your limits make sense for your work.
🔹 Understand what your settlement agreement actually releases you from if a claim occurs.

**A Notary journal isn't just a record of a notarization—it can become an important record of the circumstances surrounding that notarization.**

And one more thing: **E&O insurance isn't just a box to check. It's part of protecting the business you've worked so hard to build.**

This case is a great reminder that professionalism isn't only about what you do at the signing table. It's also about how well you document, protect, and manage your risk.
