When you are unemployed, unemployment benefit can usually be used. However, there are people who do not meet the requirements to receive it, and this has a time limit, after which those who remain unemployed can resort to additional support called unemployment benefit. The Comparajá website clarifies who is entitled to this grant and how to apply for it.

If you have low income or are in a situation of long-term unemployment, you can request this additional benefit along the lines that will be explained below.



What is unemployment benefit?
According to the Practical Guide - Social Unemployment Benefit, Initial or Subsequent to the Social Security Unemployment Benefit , the social unemployment benefit is a monthly support that is paid in two situations:

When all the unemployment benefit to which you were entitled has been received or when the requirements for its attribution are not met;
If the household income, per person, does not exceed € 351.05 (80% of the Social Support Index ) - this is called the “resource condition”.
There are two categories of social unemployment benefit: initial - for those who do not meet the requirements for receiving unemployment benefit - and subsequent - for those who have already received all of that benefit to which they were entitled.

Who's entitled?
According to the aforementioned Guide, the following are entitled to unemployment benefit:

Anyone who has already received unemployment benefits in full and cannot therefore receive more;
Workers who had an employment contract and who paid for Social Security (or who were suspended from the contract for wages in arrears);
Domestic service workers, provided they have been hired full time and have entered into a written agreement with the respective employer to make discounts on the real wage and that the same agreement has been delivered and accepted by the Social Security services;
Undifferentiated agricultural workers registered with Social Security until December 31, 2010;
Agricultural workers registered with Social Security as from 1 January 2011;
Workers appointed to management positions, provided that, on the date of their appointment, they were part of the company's staff as workers hired for at least one year and included in the general Social Security regime for employees;
Workers hired as partners (managers or not), but totally unpaid, for a non-profit entity;
Basic and secondary education teachers;
Customs sector workers;
Former military personnel on a contract or volunteer basis.


Which people can this support be denied?
They are not entitled to unemployment benefit:

Workers who are registered with Voluntary Social Security;
People who work at home;
Old age and disability pensioners;
Workers who are unemployed, but who continue to exercise another professional activity;
Who, at the date he became unemployed, is already able to receive retirement.


What requirements must be fulfilled in order to have access to this social benefit?
From the outset, there is a specific condition imposed by Social Security to access this support: only those who, together with the household or individually, hold movable assets (that is, bank deposits or financial assets) below 240 times the IAS - therefore, 105,314.40 euros.

In addition to this requirement, it is also mandatory:

Be resident in Portugal;
If you are a foreigner, you have a residence permit or other permit that allows you to have an employment contract;
In the case of refugees or stateless persons, having a valid temporary protection title;
Being in a situation of involuntary unemployment;
Not being engaged in a paid activity;
Be registered at the Employment Center;
Have had a job with an employment contract.


Warranty period
In addition, a warranty period covering two situations must be met:

Have worked with a contract and paid Social Security for at least 180 days in the 12 months immediately preceding the date of unemployment;
Or 120 days in situations of involuntary unemployment due to expiry of the fixed-term employment contract or termination of the employment contract on the initiative of the employer during the trial period (however, it is only possible to benefit from the latter situation every two years from the date termination of the social unemployment benefit attributed for this reason).
Is it possible to receive the unemployment benefit in conjunction with other support?
It is possible to receive this support together with:

Compensation for socially necessary work from the Employment Center (situation in which an additional 20% of the IAS value can be earned);
Pensions and indemnities related to occupational risks (such as accidents at work and occupational diseases) and others of the kind (namely disabled people in the Armed Forces).
However, unemployment benefit cannot be accumulated with:

Support for informal caregivers;
Allowances related to the loss of remuneration from work (parental leave, sick pay, among others);
Social Security pension or other mandatory social protection system (including civil service and Social Security systems from other countries);
Regular payments made by employers for having decided to terminate the employment contract;
Pre-retirement.
How to apply for social unemployment benefit?
To request this benefit, you must complete the following forms:

Model RP5000-DGSS - Unemployment Benefits Claim (which is completed online by an Employment Center employee);
Model RP5044-DGSS - Declaration of unemployment status issued by the employer or, if the employer refuses to do so, by the Authority for Working Conditions (ACT);
If the contract is suspended due to overdue wages: Model GD18-DGSS ;
Model MG8-DGSS - Declaration of Composition and Income of the Household;
Model MG8 / 1-DGSS - Declaration of Household Composition and Income - Continuation Sheet;
Model MG8 / 2-DGSS - information and instructions for completing the Declaration of Composition and Income of the Household.
In addition to the aforementioned forms, there are other documents that can be requested by Social Security (for example: IRS statement, salary receipts, etc.) depending on your specific situation.

What happens if the labor organization does not want to issue a declaration of unemployment?
In this case, ACT will do so within 30 days of the employee's request.

What is the value of the unemployment benefit and how long does it take?
For those who live alone, the amount earned is the lower of these two amounts: 80% of IAS (351.05 euros) or the value of the net reference remuneration.

For those who live with family members, the value will be the lower of these two: 100% of the IAS (438.81 euros in 2020) or the value of the net reference remuneration.



How to calculate the net reference remuneration?
This is the average of the net wages that the labor entity declared to Social Security and that it paid the worker in the first six months of the last eight, counting from the month prior to the one in which unemployment occurred.

Regarding the time period during which the subsequent unemployment benefit can be received, it varies according to the age of the beneficiary at the date when he / she no longer receives unemployment benefit and the number of social security discounts that had been considered for the attribution of what you previously received.

How do you receive?
This benefit is paid by bank transfer or postal order (by post). In a situation of long-term unemployment, it is possible to receive this support, as long as the beneficiary also complies with his obligations to Social Security and the Employment Center, demonstrating an active job search and maintaining communication with these institutions. .
