🚨 LABOR CASE OF THE WEEK: Ang Kaso ng Iced Coffee at ang Habitual Tardiness 🚨

Mga anteh at koya, gather around for our weekly legal exchange! Magsitabi muna ang mga laging late diyan, baka kayo na ang next na ma-feature dito (peace). 🏃‍♀️💨

The Scenario: "Feeling Tagapagmana"
Meet Beshie (hindi tunay na pangalan, baka ma-Tulfo tayo). 8:00 AM ang shift ni Beshie. Pero si ate, 9:30 AM na dumadating araw-araw. Pagpasok sa opisina, hindi man lang mukhang stressed sa commute, at may bitbit pang iced coffee!

Nung binigyan ng HR ng Notice to Explain (NTE), ang excuse ni Beshie: "Traffic po sa EDSA, boss. Wala pong masakyan."

After 5 written warnings, suspension, at sangkatutak na memos, na-fed up na si Employer. You're terminated! ✂️

Umiyak si Beshie sa NLRC at nagsampa ng kaso. "Illegal dismissal ito! Wala kayong puso, alam niyo namang traffic talaga sa Pilipinas! Isang oras lang naman eh!" 😭

The Verdict: Ano ang sabi ng batas? ⚖️

Sorry, Beshie. Totoo naman, nakaka-cry ang traffic at commute sa Pinas—we totally validate that struggle! (Sino ba naman ang hindi pa naiyak sa pila sa MRT, di ba?)

BUT legally speaking, grounding your termination on Habitual Tardiness is perfectly valid. Under Article 297 of the Labor Code, papasok ito sa Gross and Habitual Neglect of Duties.

Sabi nga ng Supreme Court sa mga ganitong kaso: Hindi pwedeng gawing eternal excuse ang traffic. Kung araw-araw namang traffic sa ruta mo, it is expected that you adjust your wake-up time. Punctuality is a reasonable company rule. Kapag naging hobby mo na ang pagiging late kahit binigyan ka na ng warning, may karapatan si employer na i-let go ka.

Para sa mga Employees: Alarm clocks exist for a reason! ⏰ Kung alam mong 2 hours ang byahe, wag gumising ng 7:30 AM. Wag nating gawing personality trait ang "Filipino Time." Baka mas mahal pa ang kape mo kaysa sa sweldo mong puro lates at undertime.

Para sa mga Employers: You can fire a habitually tardy employee, BUT you must follow Due Process (Twin-Notice Rule). Bigyan ng First Notice (NTE), bigyan ng chance magpaliwanag, at saka bigyan ng Notice of Termination kung valid talaga. Hindi pwedeng sumigaw ka lang ng "You're fired!" habang nagtitimpla ng Milo sa pantry.
