QUEBEC IMMIGRATION News

The selection of skilled workers will be transferred from the Bureau d’immigration du Québec in Hong Kong to our offices in Montréal

The Ministère de l’Immigration et des Communautés culturelles wishes to inform its clientele that as of April 1, 2013, the selection of skilled workers will be officially transferred from the Bureau d’immigration du Québec in Hong Kong to our offices in Montréal.

In the meantime, any new immigration application submitted under the skilled worker program must be sent to our offices in Montréal as of January 1, 2013.

The Ministère would like to reassure its clientele that it will continue to pursue its activities in Asia and Oceania with the same due diligence. When necessary, selection interviews conducted by the Ministère with immigration candidates from Asia or Oceania will be held at the locations designated for this purpose in the territories concerned.

No changes for other immigration categories

This change will not have any effect on files in the businesspeople sub-category; these files will continue to be processed in Hong Kong. This change will also have no effect on the family sub-category since, for several years now, the processing of these files for all territories across all continents has been done entirely by mail, from our offices in Montréal.

Canada scraps nearly 300,000 skilled immigrant applications

OTTAWA - Canada plans to eliminate a backlog of stale immigration applications by skilled workers, in a potentially controversial move designed to enable immigrants whose skills are in greater current demand to enter the country faster.

Some Canadian employers have complained that backlogs have hobbled the immigration system and made it unable to respond nimbly to demand for foreign workers in higher growth sectors like video-gaming and the oil patch.

Finance Minister Jim Flaherty said on Thursday that Canada now plans to return almost all of the 300,000 foreign skilled worker applications that were filed before February 27, 2008, along with their C$130 million ($130 million) in fees. Some have been waiting for a decade or more.

Flaherty made the announcement in his annual budget, saying the reforms would make the system faster and more efficient.

"We will ensure it is designed above all to strengthen Canada's economy. As a result we will be better able to fill gaps in our labor force," Flaherty told the House of Commons in his budget speech.

It is an irony that national unemployment is running at more than 7 percent while certain industries face labor shortages, but such employers may be looking for people with certain skills not found among most of the unemployed.

But someone who applied in 2001 may not have the skills needed in 2012, and if she or he was 42 when they applied would now be 53 and have fewer working years.

Canada has traditionally welcomed high numbers of immigrants. The country lets in 250,000 people a year and because of its below-replacement birth rate it will eventually rely on immigrants for any growth in its labor force.

It has a total backlog of one million would-be immigrants, about 460,000 of whom are skilled workers. Also in the backlog are applications by family members of recent immigrants, as well as investors and entrepreneurs.

The government allows 75,000 skilled workers to immigrate each year. In 2008, Ottawa started fast-tracking new applications by skilled workers but it quickly had to put a cap on those in order to be able to work through those still in the queue.

As a result of the measures announced on Thursday, it will be able to raise the number of applications it fast-tracks, with a planned eventual turn-around time of six months.

It had already told those in the backlog that they were welcome to withdraw their applications and reapply under the new rules. But if their skills are now in less demand, their chances of acceptance will also be lower.

The budget also announced somewhat less developed plans to revamp the rules under which investors can immigrate. Previously, they were required to invest large sums of money with Canadian governments. But the intention now is to require them to invest directly in the economy.

Immigration Levels and the Skilled Worker Programs
The popular Federal Skilled Class (FSWC) will experience slight changes in its immigration target for 2013. This year, the program is expected to issue between 55,000 and 57,000 Permanent Resident visas. The goal for 2013 has been lowered slightly, with a desired range of between 53,500 and 55,300 visas. Despite this slight change, the program will remain the largest Permanent Residency path to Canada.
Given that the FSWC will issue fewer visas next year, potential applicants may face a tighter race to submit their applications in a timely fashion. According to Attorney David Cohen, some individuals have already begun preparing in advance to ensure that their applications are submitted quickly when the 2013 intake cycle begins.
The Quebec Skilled Worker (QSW) Program will maintain its target goals for 2013. It is the third largest program for Canadian Permanent Residency, after the FSW and the combined Provincial Nominee Programs. The QSW program is currently open and accepting applications from individuals with experience in one of 110 areas of training/fields of study.

Canada announces new skilled immigration rules

Canada has announced that the Federal skilled Worker Program (FSWP) is to reopen in May 2013. The FSWP is Canada's main skilled migration program and enables applicants to apply for permanent resident status if they have adequate skills and experience.

Speaking at an Ottawa press conference on 19th December 2012, Jason Kenney, the Canadian minister with responsibility for immigration policy, told journalists that the FSWP would re-open to applicants on 4th May 2013 using a revised points-based selection system. He also revealed the new selection criteria that will be in place when the system goes live.

Mr Kenney closed the FSWP to new applicants who did not already have a Canadian job offer from 1st July 2012. When he announced the closure, Mr Kenney said that his department would draw up a new set of criteria for selection which would ensure that successful applicants under the FSWP would be more likely to succeed when they arrived. Mr Kenney said in June that the changes would enable successful applicants to 'hit the ground running' when they arrived in Canada.

Mr Kenney told journalists on 18th December that the new FSWP assessment criteria will include the following
• A higher minimum threshold of skill in either English or French (Canada's two official languages) than before. Applicants will now have to demonstrate by way of a test that they meet level 7 of the Canadian Language Benchmark.
• A greater number of points will be granted to younger applicants than under the old system.
• A new 'Educational Credential Assessment (ECA) scheme to allow the Canadian government to compare foreign educational qualifications with Canadian ones so that their worth can be better assessed
• A reform of the 'Arranged Employment' rules so that those with an offer of employment can be hired more quickly
• Additional points granted to FSWP applicants if their spouse has ability in English or French and if he/she has work experience in Canada

Mr Kenney said 'the new FSWP criteria will ensure Canada is selecting the skilled immigrants our economy needs, who are the most likely to succeed and fully realise their potential in Canada.'

From May 2013 onward, in order to demonstrate that they have an adequate standard of English, or French, applicants will have to be assessed by an approved agency. A list of these agencies can be found on the Citizenship and Immigration Canada (CIC), website. CIC is Mr Kenney's department in the Canadian government.

They will also have to have educational qualifications received from non-Canadian educational establishments assessed by an approved Canadian organisation. This comparison must be performed before the applicant arrives in Canada. This will enable an applicant to assess whether their qualifications are adequate and if necessary to undertake further training, before leaving home, a CIC statement said.

Arranged Employment is a system whereby those with a job offer in Canada before they apply to the FSWP can score an extra 10 points on the FSWP 'points grid'. The Canadian employer must be approved by Service Canada, which is an agency created in the Canadian Department of Human Resources and Skills Development.

At present, once a Canadian employer has offered a foreign national a job, the employer must make an Arranged Employment request to Service Canada. If the request is approved, Service Canada will then send an Arranged Employment Opinion (AEO), to CIC giving details of the job in question, the pay and the employer's history. The AEO will also state that the job is genuine and permanent and will ask CIC to expedite the applicant's request. However, it remains to be seen what the rules will be after the changes are made.

After Mr Kenney announced the proposed changes to the system in August, Ratna Omidvar, who is president of the Canadian charity the Maytree Foundation and board chair of the Toronto Region Immigrant and Employment Council, said that the change in focus may mean that Canada misses out on talent. He called for 'a little less rigidity' in the new system. Other critics have said that the focus on language ability might, in effect, discriminate against non-European applicants. Mr Kenney has dismissed these worries.

CIC says there is 'a large body of research which has consistently shown that language proficiency and youth are two of the most important factors in the economic success of immigrants'.

The new regime will not apply to anyone with an existing Canadian job offer or a PhD who applies before May 4th 2013. CIC has announced that it expects that, when the FSWP reopens to new applicants, it will take about three months for applications to be processed.

UK Immigration warns of scams

On 29th November 2012, the UK Border Agency (UKBA) issued a warning about 'fake UK Border Agency websites and calls'. The warning advises people who want to work in the UK and students who are already studying in the UK to be aware of a number of frauds that are being carried out by criminals pretending to work for the UKBA.

The statement warns firstly of websites offering fake UK jobs online. Foreign nationals who apply for a job will receive a response saying that they have been successful. They are then directed to a link and asked to pay for a UK Tier 1 or Tier 2 visa and work permit. The UKBA warns people not to apply for visas or to make payments on these sites. They are not operated by the UKBA. You cannot get a visa in this way.

The statement also warns about a telephone scam targeted at overseas nationals already studying in the UK. These students may receive a phone call from someone claiming to work for the UK immigration authorities. The caller will give a false name and a contact number. The caller will explain that there is a serious problem with the student's immigration status and request an immediate payment to prevent deportation. The UKBA warns people not to pay.

In another scam, a caller claiming to work for UK immigration authorities may contact a foreign national newly arrived in the UK to work, perhaps with a tier 2 (general) visa. The caller will ask the victim to pay a deposit immediately to prove that he has sufficient funds to support himself until he receives his first salary payment. The UKBA warns students and workers not make payments. The UKBA does not ask for payments over the phone in this way. It has reported the scams it knows about to the police. It adds that there may be other frauds it does not know about.

The UKBA advises anyone who has received suspicious calls or e-mails or has seen a suspicious website to report it to the police's Action Fraud website (www.actionfraud.police.uk) or to call Action Fraud on 0300 123 2040.

It also advises that the genuine UKBA website is to be found at www.ukba.homeoffice.gov.uk and warns students to be sure to check that they are not directed to other, non-government, email addresses from sites that seem to belong to the UK immigration authorities. It warns students to check any addresses used on letters that they receive, which claim to be from the UKBA, against a list of contact details to be found on the UKBA website.
