Receiving a Show Cause Letter does not mean you have already been terminated.
In a recent Industrial Court case, an employee resigned shortly after receiving one and later claimed that she had been forced to resign. However, the Court found that she resigned voluntarily and dismissed her claim.
If you receive a Show Cause Letter, PIP or misconduct allegation, don’t panic. Understand the allegations, collect your evidence and prepare a proper response.
Most importantly, speak to a lawyer before you resign, sign anything or make an emotional decision. Don’t turn the company’s Show Cause Letter into your own resignation letter.

明天PIP结果就出来了,你已经99%觉得自己一定Fail。
这时候很多员工第一个念头就是:
“与其等公司炒我,不如我今天自己辞职。”
但作为一名在马来西亚处理过超过500宗雇佣与劳资纠纷案件的律师,我经常提醒员工:
不要因为害怕明天的结果,就在今天冲动辞职。
如果你认为整个PIP过程本来就不公平,例如Target不断改变、没有合理辅导、没有足够改善时间,甚至无论你怎么做,公司都说你不达标,那么更应该先把证据保存好。
Email、WhatsApp、PIP Target、Performance Review、老板的Instruction,都可能很重要。
自己辞职,和公司正式Terminate你,法律位置可能完全不同。
所以,在你按下“Send”把Resignation Letter发出去之前,先搞清楚自己到底在做什么。
不要替公司完成他们本来要做的决定。
工作可以再找,但自己的法律权利,不要因为一时害怕就轻易放掉。

As a lawyer who has handled more than 500 employment-related matters in Malaysia, I have seen employees push themselves to the limit just trying to survive a PIP or Domestic Inquiry.
Some lose sleep. Some develop anxiety. Some completely lose confidence in themselves.
My advice is simple: take the process seriously, protect your evidence, respond properly — but don’t destroy your mental health trying to satisfy an impossible process.
If the company eventually terminates you unfairly, understand your legal rights and challenge it through the proper process.
And most importantly: don’t resign impulsively just because you receive a PIP, show-cause letter or DI notice.
Know your position before making your next move.
