An LPA only works if it's in place 𝒃𝒆𝒇𝒐𝒓𝒆 you lose capacity. Once you can no longer make decisions for yourself, it's too late to create one.

At that point, your family would need to apply to the Court of Protection — a process that typically takes 6–12 months.

If you haven't put an LPA in place for both property, finances, and healthcare, your family don't have the legal authority to act on your behalf when it matters most.

HMRC's latest figures confirm IHT receipts hit £8.5bn for the 2025–26 tax year.

How is this happening?

The nil-rate band is frozen at £325,000. It has been since 2009. Meanwhile, property prices have increased significantly. More estates are crossing the threshold every year, not because families are dramatically richer, but because the goalposts haven't moved.

And it's about to get more complex. From April 2027, pensions will also be brought into the IHT calculation.
