How often do you consider your processes and if they could potentially be discriminatory?
Recently an Employment Tribunal (ET) found that a company recently discriminated against an employee by sending an important email to a work account which they did not have access to while they were off work on Maternity Leave. Whilst this decision was ultimately overturned by Employment Appeal Tribunal (EAT), it does show that consideration needs to be given to the communication process with employees who may be absent from the business for a variety of reasons.
They are still employees and need to be communicated with in an appropriate way.
Overall, simple actions could be potentially discriminatory and it is important to have correct policies and procedures in place and that those managing people and teams have the correct knowledge and understanding of them.
