The UK government has announced the most significant reform of the legal migration system in decades, introducing a new “Earned Settlement Model” based on contribution, character, residence, and integration.
Key Changes Every Migrant Should Know
1. Settlement period doubled to 10 years
Reductions will apply only to migrants who demonstrate strong contributions.
2. Low-paid workers face a 15-year pathway
Affecting those who entered on Health and Social Care visas between 2022 and 2024.
3. Migrants relying on benefits may face a 20-year wait
This would be the toughest requirement in Europe.
4. Illegal migrants and visa overstayers may face up to 30 years before settlement eligibility
This represents the longest waiting period ever proposed.
5. Access to public funds will be restricted
Benefits and social housing will only be available after becoming British citizens, rather than upon receiving settlement.
6. Fast-track routes remain for key contributors:
• NHS doctors and nurses: 5 years
• Global Talent, Innovator Founders, and high earners: possible settlement after 3 years
• Higher-rate taxpayers may receive reduced qualifying periods
7. Higher English-language requirement
Integration measures such as volunteering may reduce qualifying periods.
Who Will Keep the Existing 5-Year Pathway?
• Immediate family members of British citizens
• Hong Kong BN(O) route
• Skilled frontline public service workers
Why This Matters
Over 1.6 million migrants are expected to become eligible for settlement by 2030 under the current system.
The government states the reform aims to introduce a “fair, controlled and contribution-based model”.
Additional Policy Details
• Migrants who pay national insurance contributions will generally qualify after 10 years, while higher-rate taxpayers may qualify sooner.
• Discounts may apply for strong integration, including advanced English-language ability and volunteer work.
• Prerequisites for settlement will include being employed, maintaining a clean criminal record, meeting higher English-language standards, and not claiming benefits.
• Currently, settlement is typically granted after 5 years, giving access to public funds. The new model will restrict such access to British citizens only.
• Citizenship still requires passing the Life in the UK Test and paying additional fees.
• Recognised refugees who entered legally will now be subject to a 20-year settlement period, although they will continue to access public funds under stricter conditions.
• The Earned Settlement Model will be based on four core pillars: character, integration, contribution, and residence.
