Last Friday, our Bank Partners team, Hali George, RuPaul Unadkat and Lauren Webb, were proud to attend the Kingston & Richmond NHS Trust Nursing & Midwifery Conference 2026 at Warren House.

Invited by the Deputy Chief of Nursing, the day brought together colleagues from across the Trust to celebrate International Nurses Day and recognise the incredible contribution nurses make across healthcare every day.

Bank nurses play a vital role in supporting services, colleagues and patients with flexibility, professionalism and compassion, often stepping in when they are needed most. We are proud to work alongside such dedicated healthcare professionals and to support the outstanding work taking place across Kingston & Richmond NHS Trust.

We’re already working with Trusts at different stages of this journey, including:

◾Assess current exposure to umbrella-related risk
◾Review the number and governance of suppliers in their staffing supply chain
◾Consider whether existing models provide sufficient control ahead of April 2026

A dual Bank and MSP model combines direct workforce engagement with structured supply chain control. This helps reduce risk while maintaining safe and reliable access to temporary staff. Find out how we are supporting Trusts in managing JSL risk. https://tinyurl.com/yc8msf6n

Joint & Several Liability (JSL) means tax risk can move up the supply chain.

Control, not distance, is the key defence. Many NHS organisations are already:

◾Reviewing agency arrangements
◾Rationalising supply chains
◾Strengthening compliance frameworks

We have been operating compliant umbrella models and controlled supply chains for many years. Request a free supply chain compliance audit to review your current model and identify any potential risks. https://tinyurl.com/2m8zta7y

HMRC’s position is clear:

Those who benefit from labour must take responsibility for how it is supplied.

Under Joint and Several Liability (JSL):

◾Having policies, audits or supplier questionnaires does not prevent liability
◾Liability can arise even where an organisation acted in good faith.

The key risk mitigator is structural control of the supply chain, not just oversight. As compliance risk increases, assurance alone is no longer sufficient.

If you don’t have structural control of your supply chain, now is the time to review it. Speak to us about how our dual Bank and MSP solutions can support you. https://tinyurl.com/27vsjhxx

Historically, NHS Trusts have relied on agency assurances, framework compliance and supplier due diligence.

From April 2026, under Joint and Several Liability (JSL), these measures may not provide full protection.

For NHS organisations, this introduces increased:

◾Financial risk (unexpected tax liabilities)
◾Governance risk (audit and assurance scrutiny)
◾Reputational risk (public accountability for compliance failures)

Liability is shifting. Make sure your organisation has the visibility and oversight it needs. If you cannot fully manage your supply chain, speak to us about how we can help. https://tinyurl.com/3m6p4d5c

If an umbrella company fails to operate PAYE or National Insurance correctly, HMRC may recover the unpaid tax from any organisation in the supply chain, not just the umbrella company itself.

This can include NHS Trusts and other end clients.

Greater accountability means greater risk for organisations without full visibility or control of their supply chain.

From 6 April 2026, new HMRC legislation will introduce Joint & Several Liability (JSL) across labour supply chains that use umbrella companies.

Under JSL, if an umbrella company fails to operate PAYE or National Insurance correctly, HMRC may recover the unpaid tax from any organisation in the supply chain, not just the umbrella company itself. Importantly, liability may apply even where there is no direct contractual relationship with the umbrella company.

If you don’t have full visibility of your supply chain, we can help. Find out more: https://tinyurl.com/yc7v33jz
