Can you win an employment tribunal claim if you’re representing yourself?

Yes and this age discrimination case is a great example of why you shouldn’t assume that being a litigant in person means you’re at a disadvantage.

A 73-year-old claimant brought a direct age discrimination claim after a job offer was withdrawn shortly before he was due to start, following the employer becoming aware of his age.

The Employment Tribunal found that age materially influenced the decision and upheld his claim under s.13 Equality Act 2010.

But perhaps the most encouraging part for anyone representing themselves is this:

The employer didn’t have to admit discrimination for the Tribunal to find it.

The Tribunal looked at the timeline, surrounding circumstances and evidence to work out what had happened.

If you’re a litigant in person, let this case inspire you and don’t let the fact that the other side has lawyers convince you that you don’t have a case.
