Is AI making workplace disputes harder to resolve? 🤖⚖️

With single UK Employment Tribunal claims surging by 39%, more employees are using AI tools to draft complex, multi-page grievances.

While AI makes it easy to generate long lists of potential legal claims, it doesn't make those claims accurate. For employers, sorting fact from fiction still requires substantial time and resources.

Ultimately, evidence matters far more than the number of pages AI can produce.

Find out how this shift is impacting businesses and what steps you can take to protect your organization in our latest article:

When high-level allegations hit the C-suite or senior leadership, the stakes are incredibly high. Managing complex workplace misconduct requires far more than standard HR processes, it demands absolute impartiality, robust legal compliance, and deep psychological awareness.

At Birch-HR, we are regularly instructed by organisations to conduct independent, highly confidential investigations into sensitive matters, including bullying, harassment, and sexual misconduct.

An objective, external investigation protects the integrity of your process, supports everyone involved, and ensures your next steps are backed by evidence, not bias or assumption.

Read our latest insight into how we handle these sensitive cases, from drafting precise Terms of Reference to delivering legally robust frameworks for senior decision-makers:

With temperatures rising across the UK, employers should be taking a proactive approach to employee health, safety and wellbeing during hot weather.

There is no maximum legal workplace temperature, but employers still have a duty to ensure working conditions are reasonable and do not put employees at risk. That means thinking ahead about heat-related risks, workplace comfort and support for vulnerable staff.

Key considerations include:

Carrying out heat-related risk assessments

Making drinking water readily available

Improving ventilation and airflow where possible

Considering flexible hours or adjusted working patterns

Reviewing dress codes and uniforms

Supporting vulnerable employees, including pregnant workers and those with underlying health conditions

Providing extra care for outdoor workers, including rest breaks and shade

Hot weather can affect concentration, productivity and safety, while increasing the risk of dehydration, heat exhaustion and workplace accidents.

Managers should also know how to spot the signs of heat stress, including fatigue, dizziness, headaches and confusion, so they can respond quickly and appropriately.

A simple, thoughtful approach can make a real difference to employee wellbeing and workplace culture.

🚀 When workplace performance concerns aren't handled fairly, professionally, and consistently, everybody loses.

Whether you're an SME director, business owner, or education leader, managing underperformance can feel uncomfortable. Many leaders worry about “getting it wrong,” avoiding difficult conversations, or sparking conflict.

But delaying action or handling concerns inconsistently only leads to bigger headaches down the road—think grievances, sudden absences, tanked morale, and tribunal risks.

Effective performance management isn't about blame; it’s about clarity, structure, and fairness. It means:
✨ Having honest, early conversations
✨ Setting measurable, achievable expectations
✨ Keeping tight written records (and chronologies)
✨ Offering reasonable support and training
✨ Applying policies consistently across the board

Unfortunately, we’re still seeing the flip side: employees facing poor workplace practices from unscrupulous employers who ignore fair procedures, cutting off access and expecting "protected conversations" to cover it up.

Strong workplaces are built on accountability, communication, and respect on both sides, even when difficult processes need to progress.

Employment Rights Update – 6 April 2026

📢 Big changes are here: Is your HR framework ready for April 2026?

The employment law landscape in the UK has just shifted. For leaders and HR professionals, this isn't just about ticking boxes, it’s about leading with a people-first mindset in a new regulatory era.

From day-one rights to enhanced redundancy protections, the "burden of proof" has shifted toward employers. Are you prepared to justify your decisions with clear, evidence-based rationale?

Key shifts you need to know:

✅ Day-One Rights: Statutory Sick Pay and Family Leave are now available from the first day of employment.

✅ Enhanced Protections: Stricter rules on collective redundancy and stronger whistleblowing safeguards.

✅ Compliance Essentials: Mandatory 6-year record-keeping for holidays and pay.

✅ Manager Training: Leaders must now be equipped to handle day-one rights and flexible working requests with consistency and transparency.

Don’t wait for a grievance or a gap to appear. Now is the time for a proactive compliance audit to identify risks before they become issues.
