Good news for Small Businesses: New Employment Equity Amendments

The Employment Equity Amendment Act brings key changes to employment regulations. This summary is based on information from Cliffe Dekker Hofmeyr, who have provided detailed insights into the amendments. If you have fewer than 50 employees, these changes could significantly reduce your compliance responsibilities.

Here's what you need to know:

1. Less Administrative Burden: Small businesses with fewer than 50 employees are now exempt from many employment equity requirements. No need to develop or submit formal equity plans or reports—meaning less paperwork and more time for your core business.

2. Compliance Certificates: You can still obtain a compliance certificate (important for state contracts) by showing no adverse CCMA or court rulings for unfair discrimination or minimum wage issues in the past 12 months.

3. Fair Employment Practices: The Act still prohibits unfair discrimination, so it's crucial to maintain fair practices, even without formal reporting requirements.
