The courts are beginning to follow Spokeo's precedent that an employer cannot be sued for mere technical violations without any demonstration of harm. That said, employers are still advised to be extremely careful in following FCRA regulations, and to use a qualified screening company to help them do so.

A federal judge threw out a proposed class-action lawsuit against ride-sharing company Lyft, finding that the plaintiff could not demonstrate that he experienced actual harm as a result of technical employment screening violations.

Philadelphia has made some very significant changes to its laws regarding employment background checks, going beyond ban the box. Among other items, employers may not consider convictions older than 7 years, the intent to run a background check may not be stated until after a conditional offer, and applicants have the right of private action (i.e. they can sue). These rules apply even to companies with only one Philadelphia employee.
