It is necessary to clarify that Mulla’s Principles of Mahomedan Law is a respected reference work and frequently cited for its exposition of Islamic personal law as applied in the sub-continent.

However, it is not a source of law in itself. Where the statutory scheme or binding judicial authority provides clear guidance, resort to such secondary commentaries must remain subordinate. Kaneez Fatima’s case affirms that the legal effectiveness of a Talaq in Pakistan is governed by section 7 of the MFLO, irrespective of the form in which it is pronounced. The limited exception recognised in Kaneez Fatima is with respect to divorces effected through mutual consent (Mubara’at).

The Lahore High Court Multan Bench Multan has held that once a cancellation report is accepted by the judge, the criminal case effectively comes to an end. After that stage, the police cannot reopen or re-investigate the matter on their own. If further investigation is to be carried out, it can only be done with the permission of the judge.

The Illegal Dispossession Act, 2005 was made to protect lawful owners and occupiers from being unlawfully and sometimes violently thrown out or encroached upon. The sessions court, under this Act, is not meant to decide complicated ownership disputes. Instead, it only needs to see, based on the material provided, whether illegal dispossession has happened or not. Courts have explained that the Act gives a quick, independent, and strong legal remedy, different from normal civil cases.

A complaint under this Act can still be filed even if civil cases between the parties are already pending. Civil and criminal liabilities can run side by side without stopping each other. Therefore, a criminal complaint cannot simply be dismissed just because a civil dispute exists, unless the court finds that the complaint is a misuse of law or an attempt to wrongly turn a civil matter into a criminal one.

Even if both the complainant and the accused are co-owners of unpartitioned land, the court must still check whether the complainant has been unlawfully dispossessed by the accused.

In a recent and important judgment, the Lahore High Court has made a strong point about using technology in the criminal justice system. The Court has interpreted prosecution laws in Punjab in a way that gives more responsibility and authority to prosecutors.

Although the prosecution departments were created to reduce direct interaction between police officers and courts, such interaction has continued to grow. Recognising this, the Court has now directed police officers to:
1. Send case records through WhatsApp and Email, and
2. Prepare detailed case briefs as required under Rule 27.4 of the Police Rules, 1934.

This judgment highlights the need for incorporating the police officers’ perspective and encourages the meaningful use of modern technology in legal procedures.

My Opinion on this verdict;

This judgment is a positive step towards making the legal process more efficient and transparent. By allowing police to use WhatsApp and Email, the Court has shown that the justice system must keep up with the modern world. This saves time, reduces paperwork, and ensures that records are shared quickly and securely.

At the same time, asking police officers to prepare proper case briefs helps the prosecutors and the courts understand the facts better. It reduces confusion and makes the trial process smoother.

Most importantly, the Court has shown that public interest comes first. When technology is used wisely, it helps everyone—especially victims, lawyers, and the general public—by ensuring faster and fairer justice.
