As Parliament discusses the To***co Control (Amendment) Bill, we need an honest conversation about the laws already in place. Retailers support protecting children, but the weakest link remains awareness, implementation and enforcement.

The Ministry of Health must invest more effort in helping retailers and the public understand existing requirements, while ensuring they are applied consistently. Any new rules on sales near schools, licensing and packaging must be clear enough to work at the shop counter.

A stronger law alone will not protect children if the rules we already have are not enforced.

RETRAK was pleased to convene the NSE–RETRAK Breakfast today at the Nairobi Securities Exchange, bringing together retail sector stakeholders for a practical conversation on governance, financial readiness, fundraising and exit opportunities.

A key highlight was the NSE Fundraising and Exit Opportunities Masterclass, which explored how businesses can leverage capital markets to:

📌 Access diverse pools of local, regional and international capital
📌 Raise long-term funding through equity, bonds, rights issues and other instruments
📌 Strengthen corporate governance and investor confidence
📌 Create structured liquidity and exit opportunities for shareholders
📌 Prepare businesses for sustainable growth and succession

The session also highlighted the Ibuka Programme for SMEs, the NSE Invoice Factoring Platform, the Sustainability Finance Centre of Excellence, and the Unquoted Securities Platform (USP) as solutions and programmes supporting businesses at different stages of their growth journey.

For Kenya’s retail sector, access to appropriate capital, strong governance and investment readiness can play an important role in building resilient and scalable businesses.

RETRAK appreciates the Nairobi Securities Exchange and all members and stakeholders who participated in this important engagement.

Together, we continue to unlock opportunities for a stronger, more resilient retail sector.

RETRAK participated in the inaugural Nairobi Business Breakfast Forum 2026, convened by the Nairobi City County Government in partnership with the Kenya National Chamber of Commerce and Industry, Nairobi Chapter.

Held under the theme, “Jenga Biz, Jenga Nairobi: Partnering for a Thriving Nairobi Economy,” the forum brought together government leaders, legislators, regulators, development partners and the business community to engage on the cost and ease of doing business, trade linkages, investment, infrastructure, urban planning, security and digital transformation.
Our participation reflects RETRAK’s commitment to ensuring that the retail sector has a strong and consistent voice in decisions affecting Nairobi’s business environment. We continue to advocate for predictable and harmonised licensing, proportionate compliance requirements, efficient county services, improved market infrastructure, fair regulatory enforcement and policies that support investment, employment and affordable consumer prices.
Effective advocacy goes beyond attending forums. It requires presenting evidence from businesses, building constructive relationships with decision-makers, securing clear commitments and tracking implementation. RETRAK remains committed to working with Nairobi City County and other stakeholders to translate public-private dialogue into practical reforms for retailers of all sizes.

The current tax burden on imported tiles is hurting more than importers it is increasing construction costs, delaying projects and threatening over 15,000 jobs across distribution, retail and installation.

With local manufacturers able to meet only about 40% of demand, excessive taxation risks creating shortages, limiting consumer choice and making affordable housing even less affordable.

We support local manufacturing, but protection must be balanced. The 35% import duty already provides a strong tariff barrier. Removing the additional excise duty and Export and Investment Promotion Levy would protect consumers, jobs and investment while allowing local industry to grow competitively. It is also looking like a creation of a Monopoly.

As the Danish Strategic Sector Cooperation (SSC) Food Safety Programme concludes, RETRAK would like to acknowledge its important contribution to Kenya’s food redistribution journey.
Through Pil Holm Maagaard, the Danish SSC responded positively when we raised the need to develop national food redistribution guidelines. They facilitated a valuable training in Copenhagen, which helped us develop an action plan that became the foundation for drafting the guidelines.
What began as an identified need was transformed into a clear and practical pathway towards safer and more coordinated food redistribution in Kenya.
Thank you, Pil, and the entire Danish SSC team, for listening, responding and supporting this important work. Your contribution will continue to be felt as Kenya strengthens its systems for reducing food waste and redirecting safe, surplus food to those who need it.
